La mine de Rubaya : souveraineté congolaise, occupation armée et cadre de coopération RDC–États-Unis

La mine de Rubaya, située dans le territoire de Masisi au Nord-Kivu, dans l'est de la République démocratique du Congo, est une ressource congolaise. Elle l'était avant l'avance du M23, elle l'est aujourd'hui, et elle le restera quelles que soient les revendications, les insinuations ou les manœuvres de tout acteur régional. Ce n'est pas une position politique. C'est une affirmation du droit international et du droit souverain.

Ce point fondamental doit être énoncé clairement, car il est trop souvent obscurci dans les discussions sur le conflit dans l'est du Congo. Les débats sur les narratifs sécuritaires, les partenariats miniers et les alignements géopolitiques risquent de créer la fausse impression que la propriété ou la gouvernance de Rubaya serait, d'une façon ou d'une autre, ouverte à la négociation entre parties extérieures. Ce n'est pas le cas. La République démocratique du Congo exerce une autorité souveraine sur son territoire et ses ressources naturelles. Aucun mouvement armé, aucun gouvernement voisin et aucune puissance étrangère ne dispose d'un titre légitime pour déterminer la gestion de ces ressources.

Actuellement sous le contrôle effectif du mouvement armé M23 — que le gouvernement congolais et plusieurs rapports d'experts des Nations Unies ont associé à un soutien militaire et logistique rwandais — Rubaya est devenue un point central des discussions sur les partenariats en minéraux critiques entre la RDC et les États-Unis. Ce débat, correctement compris, ne porte pas sur un transfert de la souveraineté congolaise. Il porte sur l'aide apportée à la RDC pour exercer la souveraineté qu'elle possède déjà. Cette distinction est fondamentale.

Cet article examine l'importance stratégique de Rubaya, la base souveraine sur laquelle doit reposer sa gouvernance, le rôle qu'un cadre de coopération RDC–États-Unis peut jouer pour rétablir le contrôle congolais, et les questions plus larges que la situation soulève concernant la responsabilité, l'ingérence régionale et l'avenir de l'est du Congo.

Rubaya Mine: Strategic Interests, Regional Conflict and the DRC–USA Cooperation Framework

Rubaya mine, located in Masisi territory in North Kivu, eastern Democratic Republic of the Congo, is a Congolese resource. It was a Congolese resource before the M23 advanced on it, it remains a Congolese resource today, and it will remain a Congolese resource regardless of what any regional actor claims, implies or pursues. That is not a political position. It is a statement of international law and sovereign right.

This foundational point must be stated plainly because it is frequently obscured in discussions about the conflict in eastern Congo. Debates about security narratives, mineral partnerships and geopolitical alignment risk creating a false impression that Rubaya's ownership or governance is somehow open to negotiation between external parties. It is not. The Democratic Republic of the Congo holds sovereign authority over its territory and its natural resources. No armed movement, no neighbouring government and no external power has a legitimate claim to determine how those resources are managed.

Currently under the effective control of the M23 armed movement, which the Congolese government and multiple United Nations expert reports have linked to Rwandan military and logistical support, Rubaya has become a focal point in discussions about critical mineral partnerships between the DRC and the United States. That discussion, properly understood, is not about transferring Congolese sovereignty. It is about helping the DRC exercise the sovereignty it already possesses. The distinction matters enormously.
