Quand la RDC doit se faire rappeler son droit à la légitime défense

 

Déséquilibres diplomatiques, médiatiques et narratifs dans le conflit à l'Est

Ce qui frappe profondément dans la situation actuelle à l'Est de la République démocratique du Congo (RDC), ce n'est pas seulement la persistance de la violence armée, mais le fait que ce soit une puissance étrangère — en l'occurrence les États-Unis — qui ait dû rappeler publiquement à Kinshasa qu'elle dispose du droit légitime de se défendre, y compris avec les partenaires de son choix.
Ce rappel, pourtant élémentaire au regard du droit international, révèle un malaise plus large et plus profond : celui d'un État souverain agressé, mais constamment contenu, surveillé, conditionné et parfois dissuadé d'exercer pleinement ses droits fondamentaux.

En vertu de l'article 51 de la Charte des Nations unies, tout État dispose d'un droit inhérent et inaliénable à la légitime défense en cas d'agression armée. Ce principe est clair, universel et non négociable. Or, la RDC fait face depuis plus de deux décennies à des groupes armés non étatiques — notamment le M23 — dont le soutien extérieur par un État voisin est abondamment documenté par des rapports du Groupe d'experts des Nations unies, des ONG internationales et des organisations de défense des droits humains.

Diplomatic, Media, and Narrative Imbalances in the Conflict in Eastern Congo

What is deeply striking in the current situation in eastern Democratic Republic of the Congo (DRC) is not only the persistence of armed violence, but the fact that a foreign power — namely the United States — had to publicly remind Kinshasa that it possesses the legitimate right to defend itself, including with partners of its choosing.
This reminder, although elementary under international law, reveals a broader and deeper malaise: that of a sovereign state under aggression, yet constantly restrained, monitored, conditioned, and at times discouraged from fully exercising its fundamental rights.
